Trinity River Vision - TERMS OF USE AGREEMENT AND PRIVACY POLICY

This Terms of Use Agreement and Privacy Policy ("Agreement") constitutes a valid, binding contract between you and the Trinity River Vision Authority, a Texas nonprofit corporation * ("TRVA"), the owner and operator of the site located at www.trinityrivervision.org with respect to the use of this website (the "Site"). The content of this Site is provided subject to compliance with the terms of this Agreement. Your use of this Site signifies and constitutes your acceptance of this Agreement, as it may be amended from time to time. Please read this Agreement carefully as it forms a binding contract between you and TRVA.

Modification

Entire Agreement

This Agreement constitutes the entire agreement between you and TRVA with respect to your use of the Site. There are no other representations, warranties, terms, agreements or conditions, either written or oral, with respect to your use of the Site except as set forth in this Agreement.

Governing Law and Venue

This Agreement, the entire relationship between you and TRVA, and any litigation or other legal proceeding between you and TRVA (whether grounded in tort, contract, law or equity) shall be governed by and construed in accordance with the laws of the State of Texas, without giving effect to its choice of law rules.

This contract is fully performable in Tarrant County, Texas. Any litigation arising between the parties hereto shall be brought only in the state or federal courts having subject matter jurisdiction in Tarrant County, Texas.

TRVA has created this Privacy Policy in order to demonstrate its firm commitment to the privacy of your personal information. The following discloses its information gathering and dissemination practices for this Site:

The Site's comment form requires registrants to give us contact information (like their name and email address) and some employment information (if writing on behalf of an organization). TRVA uses contact information from the registration form to send you information about its events. Your contact information is also used to contact you when necessary and to alert you about possible items of interest. Submitting comments to us gives us permission to post or publish your comments and contact you. Under Texas law, TRVA is the “authority and instrumentality” of the Tarrant Regional Water District, a Water Control and Improvement District created and existing pursuant to Article 16, Section 59, of the Texas Constitution (the “Water District”). TRVA is authorized to assist in the coordination, implementation, and management of the Trinity River Vision Project and may exercise any power of the Water District in carrying out these objectives. Therefore, all references on the Site to TRVA also include the Water District.
